| 内容記述 | 2011年4月、公文書等の管理に関する法律が施行となり、日本国内の多くのアーキビストが、法の実施に関わる様々な課題に直面している。今から20年以上前の1990年3月、オーストラリア・クイーンズランド州において、州が運営する青少年施設における虐待を調査した「ハイナー委員会」の記録が廃棄処分となった。州法の規定に従い州アーキビストの許可のもと行われた、この一見適法な廃棄は、廃棄を要請した州内閣がアーキビストに対し情報を秘匿し、政治的圧力を加えた可能性などが問題となり、「ハイナー事件」と呼ばれるようになる。本稿では、英語圏では一定の議論を呼んだこの事件から学ぶべき教訓を引き出すことを目的とし、まず事件の背景、経緯、主たる論点等を紹介する。また議論全体を貫くテーマのひとつであるアーキビストとアカウンタビリティについて若干の考察を加え、アーキビストがアカウンタビリティを果たすには、法整備だけでは不足であることを示したい。 | |||||

| 内容記述 | Many public archivists in Japan are now facing challenges with regard to the implementaion of the Public Records Management Act that came into force in April 2011.Over 20 years ago,in March 1990,the records of the so-called Heiner Inquiry that was meant to investigate the alleged systematic abuse at a state-run youth detention centre were shredded in Queensland,Australia.The shredding was carried out with the approval of the State Archivist who had the full legal anthority and discretion to dispose of any public records of the State. | |||||

| 内容記述 | This seemingly legitimate disposal snowballed into the notorious Heiner Affair when concerns regarding the state cabinet's withholding of relevant infomation from the archivist arose and it seemed that the cabint was exerting political pressure on the archivist.The purpose of this research note is to glean lessons from the Affair by exmining how it occurred,what went wrong, and how the Australian archivists coped with the situation.The author also discusses the main concerns that were raised,including those regarding archivists' accountability,to demonstrate that more than just an archival legislation is required to ensure that an archivist acts accountably. | |||||
