内容記述 | The typical type of the house lease,“Cheon-se”, which was a traditional Korean custom, is provided as one of real property rights in the Civil Code (see Ch(zl)亡θr 6 beginning Ar亡icle 303). On the other side, the monthly rent“1?Vhol-sθ”, is an obligatory right(see Sec亡ion 7beginning Article 618). And the Code includes the institutional measure to protect a lessee by providing that the recoded lease of an immovable shall be effective against the third persons from.the time registration has been effected(see Article 621②). But the problem whether lessee’s residence can be protected under either Cheon-se or Wんol-se still depends on lessor without recording. Therefore, many strong demands to create legal measure arose for the protection of le ssee’ 刀@residence and the return of deposit. In respollse to this problem, House Lease Protection Act and Commercial Building Lease Protection Act, as a special law, took effect on 1980 and 2001 in turn. , Lease laws in the UK., U.S., Europe, and Japan mainly focuses on the protectiorl of duration in the lease. However, the Korean lease law deals more importantly with return of deposit than protection of lease duration. And it is same in the case of sale or mortgage of the leased house because the deposit ordinarily amounts to about 60%of the house price and it is the whole property of lessee, In conclusion, the Korean leaSe law was two distinctive aspects, that is, the protection of lease duration and the secure return of deposit. | |||||
