| 内容記述 | This article considered that formation process of a divorce in discussion made as a customary law in the Korea rule time by Japan． There was not the divorce in discussion in traditional Korea society． It was grasped unless there was even custom investigation of the Residency－General of Korea． However， the Government－General of Korea that after Japan－Korea merger established it as a customary law in acknowledgment of existence of divorce custom afterwards． As for the formation process of such a divorce customary law， an answer and an information by Seimu－sokan who government affairs inspector of the Government－General of Korea and director administration of justice officia正， judgment of Koto－hoin court of law， a resolution of an administration of justice association functioned． By the way， the court case about a divorce in discussion in judgment record of Koto－hoin court of law related to cancellation（a divorce）of husband and mistress relation mainly． From such a reason， this report analyzed that above an answer and an information， judgment， a resolution． In addition， analyzed the changing process of social position of the mistress that a legal position was accepted for the first time in Korea by“Minsekiho” of the Residency－General of Korea， and it was denied by the Government－General of Korea by the later． It was cleared that， through this work， historic structure for a formation process of a divorce customary law of colony Korea by colony rule mechanism． | |||||
