| 内容記述 | This article attempts to clarify the process of codification of the Korean custom and inheritance of the Japanese Law to Korea， focusing on the Minseki－h6， which was legislated in the Dai－kan Empire under the Residency－General of Korea in March 1909． The following poillts are clarified in this study． Minseki－h6 was legislated with reference to No．，120f the Japanese Family Registration Act in form， connecting the law with Korean customs in content． The features of the legislation are the concept of I－e，which symbolized Kafuch6－sei， the system of modern Japanese paternal families， and the participation of the Japanese police． The amendments of Minseki－h6 were made by building up Korean customs， making up the deficiency of the customs by referring to No．，260f the Japanese Family Registration Act and partially applying the Japanese Civil Law to Korea through the Ch6sen－minzirei． The process of legislation and amendment of the Minseki－h6， which published and authenticated the position and status of the family and individuals， was the process of codification of the Korean custom and inheritance of the Japanese Law to Korea． | |||||
