| 内容記述 | This paper is a study of Shinsei．（a form of law in the Japanese early Middle Ages）， especially transmissi．on of Shoenseiri－ rei（prohibiti．on of landed estates）by interpreting the letters of Minamoto－no－Masakuni． The letters are records of negotiation between the kokushi（国司governor of province）of Owari（尾張）and Oyumi－no－sho（小弓荘shoen of Oyumi）about Shinsei and Shoen－seiri－rei． ・ Judging from the composition of shihai－monjo（紙背文書documents appearing on the reverse side）of Heihanki（兵範 記the diary of Taira－no－Nobunori）， the date of the letters is Hogen（保元）1（1156）． So the letters are documents about Shinsei promulgated in Hogen 1． The announcement by the kokushi of Owari is different from the genuine text of the prohibition． That is highly probable that the kokushi told a lie to increase the number of shoen to abolish． Because kokushi could monopolize the infomation of prohibition， there is a information differential between kokushi and shoen． This differential enabled kokushi to arbitrarily apply Shinsei including Shoen－seiri－rei in his province． | |||||
